What makes a will legally valid in Malaysia?
A will can tick every box and still cause problems. It might name an executor who has since moved on, leave a property that has been sold, obtained new assets or give everything outright to a child who turns 18 next year.
- You’re 18 or older and of sound mind.
- It’s in writing and signed at the end by you.
- You sign in front of two witnesses who are both present at the same time, and they sign too.
- A witness, or the spouse of a witness, shouldn’t be a beneficiary, or they may lose their gift.
Why not use a template or an agent?
Templates can’t ask follow-up questions. Some will writers are paid by commission on other products, so the will can become an add-on. Our advisors are legal professionals whose only job is protecting your legacy and will. They’ll ask about second marriages, overseas or digital assets, future assets, a child with special needs and business shares, then write clauses that deal with them.

How much does it cost to write a will in Malaysia?
Prices vary by provider, typically from a few hundred ringgit for a simple will to RM1,500-RM3,000 or more for a will with trust clauses. At RightWill, wills cost RM450, RM750, RM950 or RM1,950, fixed and agreed before we start.
Is a handwritten will valid in Malaysia?
It can be, if it’s signed by you at the end and witnessed by two people present together, and you were 18 or over and of sound mind. Handwritten wills often fail on unclear wording or missing executors, so professional advice is worth it for anything beyond the simplest estate.
Do I need a lawyer to write a will in Malaysia?
No law requires it. What matters is that the will is valid and does what you intend. RightWill’s advisors are legally qualified professionals, and you pay a fixed fee.
Does my will cover my EPF and insurance?
Not if you’ve made nominations. EPF savings go to your EPF nominees, and a policy nomination in favour of your spouse, child or parent creates a trust outside your will. We check that these match your will.
Can a beneficiary be a witness?
They shouldn’t be. Under the Wills Act 1959 a gift to a witness or the witness’s spouse can fail, although the rest of the will stays valid.
